Mother Faces New DWI Charges Two Years After DWI Crash Killed Daughter

A 25-year-old woman is facing charges of drunken driving for her involvement in a Spring, Texas car accident on October 5. These charges come just 2 years after she was convicted of intoxication manslaughter in a drunken driving accident that killed her 4-year-old daughter.
The accident occurred late in the 15900 block of Kuykendahl in Harris County. Police arrested Elena Kay Fuentes after she backed her car into another vehicle in the parking lot of an apartment complex. When they arrived at the scene, Fuentes smelled of alcohol and had bloodshot eyes. After being questioned by authorities, she admitted that she had been drinking.
Fuentes was taken to a hospital to receive a blood test to check her BAC. The results of the test have not yet been released.
She was charged with driving while intoxicated, but the charge was later upgraded to a felony after police learned that she is currently serving a 10-year probated sentence. The sentence states that she is not allowed to consume alcohol. She had just received her reinstated license about a month ago.
Fuentes is under the 10-year probated sentence because of a crash on August 16, 2008 in which she was driving while under the influence. The accident, which occurred in the 5000 block of Will Clayton Parkway, killed her daughter, Bianca, who was 4 years old at the time. The young child was sitting in the front passenger seat when Fuentes' Explorer slammed into a tree. She was not secured in a child safety seat at the time of the accident and died of her injuries.
Fuentes' BAC in this fatal crash was 0.24, three times the legal limit.
