Austin Investigation of Fatal DUI Wreck Enlists TABC in Hunt for Clues
Posted on Sep 25, 2011
Austin police are working with the TABC (Texas Alcoholic Beverage Commission) to try and identify the bar or bars where Erica Lynn Nash-Wood drank before smashing head-on into a delivery truck. The fatal DUI wreck occurred early Thursday morning on Ben White in Austin. Erica Nash-Wood was driving the wrong way on Ben White when she rammed head-on into the delivery truck. Erica Nash-Wood's passenger, Christopher Johnson Peart, died at the scene of the wreck after being ejected from the vehicle.
Erica Nash-Wood admitted to police officers at the scene of the fatal DUI wreck that she was so drunk she couldn't remember where on Austin's 6th Street she had been drinking. Authorities charged Erica Nash-Wood with intoxication manslaughter and aggravated assault following the fatal DUI wreck.
TABC is hoping that witnesses, friends, or other sources of information will help pinpoint the location where Erica Nash-Wood consumed her alcohol prior to the fatal DUI wreck. If TABC can identify the establishment where she drank, they can obtain records and video surveillance from the location to determine what happened. TABC's investigation will require at least 90 days.
If TABC can identify a location, and if the agency can prove that servers there violated laws against serving visibly or obviously intoxicated patrons, the server could face fines or charges. The establishment where the server worked could face fines, suspension or the loss of its liquor license.
Our sympathies go out to friends and family of Christopher Peart, whose life was brought to such an abrupt close by a drunk driver and those who over served her alcohol and then let her drive away. We hope that anyone with knowledge of where Erica Nash-Wood was drinking will step forward. Serving an already drunk person further alcohol and then allowing them to drive away is both irresponsible and illegal. We hope that TABC locates the establishment behind this fatal DUI wreck and revokes the liquor license before continued over service of alcohol lets such a tragic wreck happen again. Texans suffer enough from DUI-related accident injuries and fatalities.
