11-Year-Old Boy Receives Citation After Being Struck by SUV

11-year-old Noah Popovich was walking to school when he was struck from behind by an SUV. After his mother reported the Texas City pedestrian accident to the police, Popovich received a citation for walking on the wrong side of the road.
The morning started just like any other - Popovich and his friends were walking to school through their neighborhood. They reached a point where the sidewalk ended and the grass was overgrown. So, naturally, Popovich and his friends stepped over to continue their walk on the side of the road, beside the severely overgrown grass.
As they were walking toward Levi Fry Intermediate School, Popovich was struck from behind by a passing SUV. The force knocked him to the ground, injuring his arm and shoulders.
The driver of the SUV got out of the vehicle to see if Popovich was all right, then continued on her way.
When Popovich's mother, Ashley Falks, found out what happened, she was extremely upset. She called the police to report the incident, but was amazed at what followed: Her 11-year-old son was issued a citation for walking on the wrong side of the road.
The driver of the SUV only received a citation for driving with an expired license.
Popovich sustained painful injuries which prevented him from attending school for over a week.
Police Chief Robert Burby stated that Popovich was in the wrong because the law requires pedestrians to walk facing traffic. He suggests that this be a learning experience, especially with Halloween right around the corner.
