Texas Motorcycle Helmet Law

In Texas, the law prohibits anyone from operating a motorcycle or riding as a passenger on a motorcycle without wearing a helmet that meets the safety standards prescribed by law. An exception to this law applies if the rider meets the following requirements:

  • The rider is at least twenty-one years old; and
  • The rider has completed a motorcycle training and safety course or the rider is covered by a health insurance plan that provides the rider with medical benefits that cover injuries sustained in a motorcycle accident.

The law prohibits a police officer from stopping a motorcycle rider for the sole purpose of determining whether the rider is exempt under Texas motorcycle helmet law.
