Is the truck driver or the trucking company liable for a truck wreck?

 

A: Both the truck driver and the trucking company may be liable for personal injuries or wrongful death caused by a truck wreck. In addition to a truck driver's liability, the trucking company that employs the driver may be vicariously liable for the driver's negligent actions under the doctrine of respondeat superior. In general, employers are responsible for any actions of an employee that are performed within the scope of his or her employment.

If, on the other hand, the driver is an independent contractor, it may be more difficult to hold the trucking company liable for the driver's actions. Proof of liability will depend on the amount of supervisory control the company had over the driver.
