I just saw a Ford Motor Company recall announcement that says that my 2001 Ford F-150 pickup truck has a gas tank that could drop out of my truck at any moment and explode. What should I do?
A:
The Texas Lemon Law statutes provide that:
A manufacturer or its designated agents must make repairs to your vehicle when needed to make it conform to manufacturer's warranties.
The manufacturer or its agents must correct any defects to make your vehicle safe and fit for its intended purpose; and
If the manufacturer can't repair your vehicle so that it will conform with the warranty standard, the manufacturer must either replace it with a comparable vehicle or take it back and refund your purchase price (less a reasonable amount for prior usage).
- Ford Motor Company has said that owners of the Ford F-150 (and the F-250 and Lincoln Blackwood) that are affected by its Ford gas tank strap recall should:
Bring their vehicles in to dealers for strap replacement in September 2011 when the new straps will be widely available.
Until that time, Ford said that you should bring your truck in to the dealer and the company will attach a cable to support the gas tank for you.
Then you can bring the pickup back in September to get the cable removed and the new metal gas tank strap installed.
One could commend Ford for taking action on the gas tank safety problem. A gas tank that can fall out of your truck without warning and suddenly ignite presents a serious safety hazard to truck occupants and others on the road. But purchasers affected by the Ford gas tank strap recall still must deal with the inconvenience, time commitment, and general nuisance of sending their truck to the shop a few extra times. We sympathize.
