Son of deceased reaches settlement with Goodyear/Dunlop Tire

Mr. Maglitto was the back seat passenger in a Toyota Tacoma pick-up truck. The truck was equipped with original equipment Dunlop Grandtrek tires. The left rear tire suffered a tread separation causing the driver to lose control of the vehicle. Mr. Maglitto was ejected and ultimately died from his injuries.

Immediately upon getting the case Denena & Points, PC, hired experts to evaluate every part of the case. B. Maglitto, the adult son of Mr. Maglitto brought suit against Goodyear/Dunlop because the tread separation was the producing cause of his father's death. The Firm alleged the tire was unsafe and defective because it lacked a simple design feature - a nylon cap ply - that would have prevented tread from separating from the rest of the tire. Once a tread leaves the tire carcass, the vehicle becomes totally uncontrollable.

Of course, the tire corporation denied the tire had anything wrong with it, denied it was at fault for the separation of the tire, denied the obvious safety and integrity benefits of a nylon cap ply and denied to compensate B. Maglitto for the tragic, premature loss of his father. After months of discovery that included depositions of corporate representatives and liability experts, numerous hearings with the court over document production and the ultimate production of tens of thousands of documents the case was ready for trial. Just two months out from trial in Federal Court the case was resolved with the tire company.
