Dangerous Product Defects and Unintentional "Boom" Functions
Over the years, our law firm has built up a good reputation for product defect litigation on behalf of our clients. A fair amount of this work relates to the many defects that end up in passenger vehicles. Some of these defects cause multiple catastrophic injuries and fatalities before a company finally admits its mistake and recalls the product from the market. So frequently, I look at the recall notices posted by the NHTSA so that I can let clients and others know of potential hazards hopefully before they actually injure anyone.
One that caught my eye on the latest list had as its subject: "Unintentional Boom Function/ Mechanical Interlock." Well clearly, no one wants a vehicle of any type that has an unintentional boom function. Nor would you want a vehicle with an intentional boom function. Boom functions represent the type of thing you generally want to avoid in a vehicle, or in any product for that matter. Upon closer reading of the recall information, I noticed that the recall related to a construction vehicle with a boom arm that might move unintentionally. Well, that's not good either. That could kill or injure someone as suddenly as an explosive boom. And those kinds of construction injuries and fatalities actually happen with fair frequency. These injuries and deaths present a degree of trauma you could hope never to see.
The important thing to remember is that if a defective product injured you, any or all of the designers, makers, marketers and sellers of that product could be liable for your injury. You could hold them accountable for the dangerous defect, and make them pay for the harm they have caused you through an unintention boom function or some other product catastrophy.
You probably could not do this on your own though. Product defect cases involve complex technical matters that require intricate presentation of the evidence to identify the source(s) of the defect. But it's not enough to show that a product contains a defect and that you have an injury. You must also show how the product defect is dangerous, and how it actually caused your injury.
